According to court documents filed on October 22nd in U.S. District Court for the Middle District of Georgia, Wright Medical is seeking to limit testimony given by [see also 'class action defense' ] the Plaintiffs treating physician during trial. Among other things, the Defense asserts that the doctor should not [see also 'wage and hour class action' ] be permitted to offer opinions on cardiac, pulmonary, psychiatric, or other topics outside his [see also 'employer rights' ] surgical specialty. We are monitoring this case very closely, as we continue to hear from patients who have suffered serious injuries, allegedly due to Wright Profemur hip replacements and Wright Conserve hip implants. Court documents filed in March in U.S. District Court, Northern District of California indicated that Wright Medical had already reached a settlement in at [see also 'wage and hour' ] least one claim pertaining to the Profemur hip. Additional court filings show that 74 federally-filed Wright hip lawsuits have been filed against the company over its Conserve line of metal-on-metal hips, all of which are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Georgia. (In re: Wright Medical Technology, Inc., Conserve Hip Implant Products Liability Litigation, MDL No. 2329) In April, Wright Medical Technology also disclosed in a regulatory fling that it had been named in additional Conserve hip lawsuits that have been consolidated in California Superior Court for pretrial handling pursuant to procedures of California State Judicial Counsel Coordinated Proceedings. All of these lawsuits allege injuries due to the metal-on-metal design of the Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing.*
